1. General provisions
This statement establishes the obligations of content creators and the platform Smokva d.o.o. (www.smokva.com) regarding age verification of all persons depicted in the content, ensuring voluntary participation (consent) and the storage and delivery of records. The platform applies a strict zero-tolerance policy under which only lawful content created by and involving adult persons (18+) is permitted.
2. Age verification
All persons in the content, at the time of uploading the content, confirm that they are at least 18 years old at the time of content creation. The platform applies a risk-based verification model and reserves the right to request confirmation of age or identity from users at any time (submission of personal documents, biometric verification/selfie). Failure to provide the requested information will result in limitations on account functionality or its termination.
3. Consent
The content creator confirms that all persons in the content participated freely and gave explicit consent. No content was created under duress, pressure, or deception. Consent must be able to be proven if required by the platform or competent authorities.
4. Mandatory user confirmation (Consent Checkbox)
When uploading content, the User must clearly confirm: "I confirm that all persons are 18+ and have given explicit consent for publication." This confirmation is a mandatory condition for uploading and is considered a legally binding statement.
5. Logging
The platform logs and stores user confirmation (User ID, consent confirmation, IP address, timestamp). This data is used for compliance audits and dispute resolution, and is provided to law enforcement agencies upon request.
6. Record keeping
Content creators are obliged to keep all documents related to age verification and proof of consent and to provide them to the platform within a reasonable time upon request. Failure to provide documentation will result in content removal and account ban.
7. Rights and control of the platform
The platform reserves the right to require identity verification, use automated and manual moderation tools, and remove any content if there are doubts about its legality or authenticity.
8. Prohibited content (Zero tolerance)
It is strictly prohibited: to depict minors, to falsely represent age, to present content without consent, to use stolen content, and any form of sexual violence.
9. Cooperation with institutions
The platform cooperates with law enforcement agencies, payment service providers, and auditing organizations. Information is forwarded in accordance with the procedures established by law.
